EAD Renewal Pending? Why the End of Automatic Extensions Changes Your Closing Date

EAD renewal pending mortgage guide: automatic EAD extensions ended, so a lapsed card can stop income mid-loan. Time your closing and protect your approval.

Quick answer (updated October 2026): An EAD renewal pending mortgage file is riskier than it was a year ago. For renewals filed on or after October 30, 2025, the 540-day automatic extension no longer applies, and the rule became final effective October 14, 2026. If your card lapses mid-process, that income can stop. Close before expiration, or qualify without it.

For years, H-4 EAD and adjustment-of-status families leaned on a safety net: file the renewal on time, and your work authorization carried on automatically while USCIS processed it. Lenders built their checklists around that too. A valid receipt plus the expired card was usually enough.

That safety net is gone for most new filings. If you, or the spouse whose income you're counting, holds an EAD, your expiration date now sits at the center of your mortgage timeline. This guide explains the change, how it affects underwriting, and a step-by-step plan for closing without a gap.

What changed: the automatic EAD extension ended

As of October 2026:

  • An interim rule dated October 30, 2025 ended the automatic extension (up to 540 days) for EAD renewal applications filed on or after that date.

  • The rule was finalized and took effect October 14, 2026.

  • Who's affected: H-4 EAD holders and adjustment-of-status (I-485-based) EAD holders, among others, who filed renewals on or after October 30, 2025.

  • Exceptions: renewals filed before October 30, 2025 keep the old treatment; TPS-related extensions and the 180-day STEM OPT extension follow separate rules.

The practical effect: if your EAD expires while the renewal is still pending, you generally lose work authorization until the new card arrives. Your employer may have to take you off payroll. For a mortgage, that's an income problem, not just a paperwork problem.

H-4 EAD eligibility itself didn't change. Spouses of H-1B workers with an approved I-140 or an AC21 extension still qualify to apply.

How an EAD renewal pending affects mortgage underwriting

A lender has to answer two questions about any income it counts: is it stable, and is it likely to continue? For EAD-based income, continuance is tied to the card.

Before: many lenders accepted an expiring or recently expired EAD plus an I-797C receipt, because the automatic extension kept the borrower authorized to work.

Now: a receipt alone doesn't keep you authorized to work for most renewals filed after October 30, 2025. Expect many lenders to want one of these:

  • An EAD valid through closing (and often with some runway after)

  • The approved renewal card in hand

  • Proof the borrower falls into an exception category

Fannie Mae's rule (B2-2-02) still says non-permanent residents are eligible on the same terms as citizens and leaves documentation to the lender, so practices vary. That's why lender overlays matter even more for EAD files. Our full EAD card mortgage guide covers baseline eligibility.

I-765 pending home loan: three common files

Scenario What a lender is likely to look at Risk level
Borrower's own EAD valid 8+ months past closing Card, income docs as usual Low
EAD expires 1–3 months after closing; renewal filed Lender policy on remaining validity; some accept, some want approval Medium
EAD expires before closing; renewal pending Income likely can't be counted until new card is issued High
H-4 EAD spouse income needed to qualify; card near expiry Whether the file qualifies on the H-1B income alone Medium to high

H-4 EAD expired? Qualify on one income if you can

The most common EAD situation we see is the H-1B plus H-4 EAD household. The H-1B income is tied to the I-797 and isn't affected by this rule. The H-4 spouse's paycheck is.

Say Ananya (H-1B) and Vikram (H-4 EAD), a hypothetical couple in Cary, North Carolina, want a $400,000 loan.

Item Amount
Loan, 30-yr at 7.40% $400,000
Principal & interest $2,769.52/month
Taxes, insurance, PMI (assumed) $700/month
Total housing payment $3,469.52/month
Ananya's gross monthly income $11,000
Housing ratio on her income alone 31.5%

Rate is the Freddie Mac weekly average, Oct 15, 2026; illustration only, not a quote or offer. Tax, insurance and PMI amounts are hypothetical.

If Ananya's income alone carries the payment and her other debts within the lender's DTI limit, Vikram's EAD timing stops mattering for approval. They can still put him on title if they choose, subject to state rules and the lender. For more, see single-income mortgages with an H-4 spouse and using H-4 EAD income to qualify.

How to time your closing around an EAD renewal

Follow these steps in order. They work for H-4 EAD and adjustment-of-status EAD holders alike.

  1. Find the exact expiration date on every EAD in the household and write it at the top of your house-hunting spreadsheet.

  2. File the renewal as early as USCIS allows. Check the current Form I-765 instructions for the filing window, and ask your immigration attorney.

  3. Work backward from expiration. A typical purchase takes 30 to 45 days from contract to closing. Leave a cushion for appraisal or title delays.

  4. Ask lenders their remaining-validity rule up front. Before you make an offer, get it in writing what each lender needs if the card expires soon after closing.

  5. Run the numbers without the EAD income. If you still qualify, the EAD becomes a non-issue for approval.

  6. Don't let the card lapse before funding. Lenders re-verify employment shortly before closing. If you're off payroll that week, the income can drop out of the file.

Timeline example

Milestone Date (hypothetical)
H-4 EAD expires March 31
Renewal filed Early, per current USCIS filing window
Last safe contract date (45-day close + 2-week cushion) about January 31
Target closing Mid-March
Final verbal VOE 1–10 days before closing, per lender

If you can't make that window, consider whether you qualify on one income, a bigger down payment, or waiting until the new card arrives.

Adjustment-of-status EAD holders: a special note

If you have an I-485 pending and work on a combo card or category (c)(9) EAD, the same timing pressure applies to renewals filed after October 30, 2025. Your H-1B may still be valid if you've maintained it, which can give you a second basis to work; your immigration attorney can confirm. See I-485 pending mortgages for how lenders view pending adjustment. STEM OPT students have a separate 180-day rule; see the STEM OPT mortgage guide.

What the rules actually say

  • DHS interim final rule, October 30, 2025: ended the up-to-540-day automatic EAD extension for renewals filed on or after October 30, 2025, with exceptions (earlier filings, TPS, STEM OPT 180-day extension). Finalized, effective October 14, 2026.

  • H-4 EAD eligibility (as of October 2026): unchanged; H-1B spouse must have an approved I-140 or AC21 extension.

  • Fannie Mae Selling Guide B2-2-02: non-permanent residents eligible on the same terms as citizens; lender determines documentation.

  • HUD Mortgagee Letter 2025-09: FHA unavailable to non-permanent residents, including EAD-only holders, for case numbers on or after May 25, 2025.

Frequently Asked Questions

Q: Can I get a mortgage if my EAD renewal is pending?
A: Possibly, but it depends on dates and the lender. If your renewal was filed on or after October 30, 2025, the receipt no longer extends work authorization automatically. Many lenders will want an EAD valid through closing or the new card. Qualifying on another borrower's income can avoid the issue.

Q: Does the automatic EAD extension still apply to H-4 EAD?
A: For renewals filed on or after October 30, 2025, no. The 540-day automatic extension ended under a rule that became final effective October 14, 2026. Renewals filed before October 30, 2025 keep the earlier treatment. Confirm your case with your immigration attorney.

Q: What happens if my EAD expires after I close on the house?
A: The mortgage stays in place; there's no visa or EAD clause in the loan. But if your income stops, you still owe the payment. Build reserves and make sure the household can carry the payment on remaining income during any gap.

Q: Can my H-4 spouse be on title even if their income isn't used?
A: Often yes. Title and the loan are separate questions; a spouse can sometimes be on title without being on the loan, depending on state law and the lender. In community property states, rules differ. Ask your loan officer and title company early.

Q: How early should I file my EAD renewal before buying a house?
A: As early as USCIS permits under the current Form I-765 instructions. Then schedule your contract so closing lands comfortably before expiration, with a cushion for delays. Your immigration attorney can confirm the filing window for your category.
