Cary, Morrisville and Apex: A Desi Homebuyer's Guide to the Triangle

Cary NC homes for Indian families: NC attorney closings, due diligence fees, new construction incentives and loan limits for Triangle buyers.

Apurva Sanghavi · · 9 min read

Quick answer (updated October 2026): Cary NC homes for Indian families usually mean new construction in Morrisville, Apex or west Cary, financed with a conventional loan under the 2026 $832,750 baseline limit. North Carolina requires a licensed attorney for key closing work, uses a due diligence fee in standard contracts, and caps builder credits by your down payment. H-1B buyers qualify for conventional loans like citizens.

The Research Triangle has quietly become one of the most popular destinations for desi families leaving the Bay Area, New Jersey and even Dallas. Tech, pharma and life sciences employers around RTP, good schools, and a growing community of temples, grocery stores and cricket leagues make Cary and Morrisville feel familiar quickly.

Buying here works differently from Texas or California, though. This guide covers North Carolina's attorney closing rules, the due diligence fee, new construction incentives in Morrisville and Apex, loan limits, and what visa holders should plan for.

Why Cary, Morrisville and Apex draw Indian families

Families we work with typically weigh three things: commute to RTP or Raleigh, school assignment, and the age of the housing stock.

Area What buyers usually find Watch for
Cary (west and central) Mix of established neighborhoods and newer subdivisions; strong amenities Older homes may need updates; school assignments can change
Morrisville Townhomes and newer single-family near RTP and the airport HOA dues; townhome vs. condo classification
Apex Newer master-planned communities, larger lots further out Longer commutes; new construction timelines
Raleigh (north and west) Wider price range, more resale inventory Different school assignments; check each address

School assignments in Wake County are set by the district and can change. Verify the assignment for each specific address rather than relying on a listing.

How NC attorney closing works

North Carolina is an attorney-closing state in a meaningful way. According to the North Carolina State Bar's Authorized Practice Advisory Opinion 2002-1:

  • Title examination and title opinions must be done by a licensed NC attorney. State law also requires an NC attorney's title opinion before title insurance can be issued.

  • Preparing deeds and deeds of trust, and advising you on legal rights under the contract or loan, are attorney work.

  • Determining that conditions are met and that funds can be disbursed is attorney work.

  • Non-lawyers can handle ministerial tasks like presenting documents and disbursing funds, but a lawyer must provide the legal services, and you get to choose that lawyer.

In practice, the buyer typically selects the closing attorney, and the attorney coordinates with your lender. Ask your agent for two or three attorneys who handle many Wake County closings, and choose one early.

The due diligence fee: North Carolina's twist

North Carolina's standard offer-to-purchase form uses two deposits: a due diligence fee paid directly to the seller, and an earnest money deposit held in escrow. During the due diligence period, you do inspections, appraisal and loan approval, and you can generally terminate for any reason.

What desi buyers often miss:

  • The due diligence fee is generally non-refundable if you walk away, except in limited situations defined in the contract. In competitive Cary neighborhoods, it can be large.

  • It's usually credited toward the price at closing if you buy.

  • Get loan approval underway inside the period. Your appraisal and underwriting should be done before it ends, not after.

  • Both deposits must be sourced. If funds come from India or a parent, move and document them before you write the offer.

Always confirm terms with your NC attorney and agent; the specific contract language controls.

Talk to a loan officer who's seen this before: Before you put a due diligence fee at risk, get a two-minute pre-approval check so you know your number and your lender's timeline fits the due diligence period. Book a call.

Morrisville NC new construction: incentives and limits

Builders across Morrisville, Apex, Holly Springs and New Hill offer incentives: closing cost credits, rate buydowns, upgrades. Fannie Mae limits interested party contributions based on your loan-to-value, which caps how much a builder can put toward your costs.

Here's a hypothetical illustration on a $600,000 new build. Principal and interest use the Freddie Mac weekly average, Oct 15, 2026 (30-year fixed 7.40%) — illustration only, not a quote or offer. PMI, taxes, insurance and HOA excluded.

Down payment Loan amount LTV Max builder contribution (Fannie, primary residence) Monthly P&I
5% ($30,000) $570,000 95% 3% = $18,000 $3,947
10% ($60,000) $540,000 90% 6% = $36,000 $3,739
20% ($120,000) $480,000 80% 6% = $36,000 $3,323
25% ($150,000) $450,000 75% 9% = $54,000 $3,116

The jump from 3% to 6% at 90% LTV can matter if a builder is offering more than you can use. Excess credits are lost, not refunded.

Two more new-construction points:

Apex NC mortgage options and loan limits

The Triangle's counties use the $832,750 national baseline for 2026, which covers most Cary, Apex and Morrisville purchases with a conforming loan. Confirm the limit for your specific county on FHFA's lookup.

For H-1B, L-1 and other visa holders: conventional loans under Fannie Mae and Freddie Mac allow non-permanent residents on the same terms as citizens. FHA isn't available to non-permanent residents since HUD Mortgagee Letter 2025-09; green card holders remain eligible.

For first-time buyers with moderate incomes: HomeReady allows 3% down for eligible borrowers under area income limits. Many dual-income tech households earn too much, but single-income families may qualify. See HomeReady 3% down income limits for 2026.

For families with parents moving in: larger Apex homes with a first-floor guest suite are popular. Parents can sometimes be non-occupant co-borrowers.

Raleigh H-1B home loan checklist

  • Pick your NC closing attorney early.

  • Get pre-approved before writing an offer with a due diligence fee.

  • Source and season funds for both deposits.

  • Verify school assignment for each address.

  • For new construction, get the builder's incentive terms in writing and compare lenders.

  • Check HOA dues and whether a townhome is legally a condo.

  • Keep copies of your I-797, I-94 and passport ready for underwriting.

What the rules actually say

  • North Carolina State Bar, Authorized Practice Advisory Opinion 2002-1: title opinions, deed and deed of trust preparation, legal advice, and determining conditions for disbursement require a licensed NC attorney; N.C. Gen. Stat. §58-26-1 requires an NC attorney's title opinion before title insurance issues. As of October 2026.

  • Fannie Mae Selling Guide B3-4.1-02: interested party contributions for primary residences capped at 3% above 90% CLTV, 6% from 75.01–90%, 9% at 75% or less.

  • FHFA 2026 conforming loan limits: baseline $832,750.

  • Fannie Mae Selling Guide B2-2-02: non-permanent residents eligible on the same terms as US citizens.

Frequently Asked Questions

Q: Do I need an attorney to close on a house in North Carolina?
A: In practice, yes. The NC State Bar says title opinions, deed and deed of trust preparation, legal advice and disbursement decisions must be handled by a licensed North Carolina attorney. Buyers usually choose the closing attorney, so ask your agent for recommendations early.

Q: Is the due diligence fee refundable in NC?
A: Generally not. Under the standard North Carolina offer-to-purchase form, the due diligence fee goes to the seller and is typically non-refundable if you terminate, except in limited cases the contract defines. It's credited toward the price if you close. Confirm terms with your attorney.

Q: What's the conforming loan limit in Wake County for 2026?
A: Triangle counties use the national baseline of $832,750 for a one-unit home in 2026. Loans above that are jumbo loans. Confirm your county on FHFA's lookup, and note 2027 limits are expected in late November 2026.

Q: How much can a builder pay toward my closing costs?
A: Under Fannie Mae rules for a primary residence, up to 3% of the price if your combined LTV is above 90%, 6% between 75.01% and 90%, and 9% at 75% or below. Credits above the cap can't be used.

Q: Can I buy in Cary on an H-1B visa?
A: Yes. Conventional loans backed by Fannie Mae and Freddie Mac allow H-1B holders on the same terms as citizens. Some lenders add overlays, such as extra reserves, so comparing lenders helps. FHA is not available to H-1B holders as of 2025.
