Quick answer (updated October 2026): A cap gap mortgage is possible. If your H-1B change-of-status petition was timely filed, your F-1 status and work authorization extend automatically, now through April 1 of the fiscal year. Fannie Mae doesn't bar closing during cap-gap, but lender overlays vary, so the documents you show and the date you close matter.

You got picked in the H-1B lottery, your employer filed the petition, and your OPT EAD is about to expire. You've also found a house. The question every cap-gap buyer asks: can I close now, or do I wait for the approval notice?

This guide explains what cap-gap does, which documents underwriters ask for, how to pick a closing date, and what happens if the petition is denied. For the basics of buying on OPT, see our guide to a mortgage on OPT.

How the cap-gap extension works in 2026

Cap-gap bridges the space between the end of your OPT and the start of your H-1B. The DHS H-1B modernization rule, implemented Jan 17, 2025, moved the end date from Oct 1 to April 1 of the relevant fiscal year, starting with FY2026 registrations.

To qualify, according to DHS Study in the States:

  • You are in a valid F-1 period, and for work authorization, a valid post-completion OPT or STEM OPT period.

  • Your employer filed a timely cap-subject H-1B petition requesting change of status, not consular processing.

  • The requested start date is within the fiscal year for which H-1B status is sought.

  • You haven't violated your status.

If those boxes are checked, F-1 status and work authorization extend automatically. If the petition is denied, withdrawn, rejected or revoked, the extension ends immediately and work authorization under F-1 stops.

Your DSO confirms eligibility, not your lender. Get the cap-gap I-20 before you talk to underwriting.

What lenders ask for during an OPT to H-1B mortgage

Underwriters must confirm you're lawfully present and your income is likely to continue. During cap-gap, your EAD may show an expired date, so you'll prove both with a stack of documents instead of one card. Our guide to immigration documents in mortgage underwriting goes deeper on each.

Stage What you'll have What most lenders want to see Overlay risk
Petition filed, EAD still valid EAD + I-797C receipt EAD, receipt, paystubs Low to moderate
Petition filed, EAD expired Expired EAD + receipt + cap-gap I-20 All three, plus employer letter High; some lenders decline
Petition approved, start date ahead I-797A approval + cap-gap I-20 Approval notice with I-94 Low
H-1B effective (Oct 1 or later) I-797A + H-1B paystub Approval + I-94 + paystub Lowest

Notice the jump in risk at row two. Fannie Mae's B2-2-02 lets the lender decide how to document legal presence, and an expired EAD with a cap-gap I-20 is a valid package. But some lenders' systems flag "EAD expired" and stop. That's an overlay, and it's why comparing lenders matters most in the cap-gap window.

Pro tip: Ask HR for a short letter stating your title, salary, start date, that the H-1B petition was filed, and that employment continues. Keep it factual.

Cap gap mortgage timing: picking your closing date

The safest closing date depends on where you are in the process. Here's how we usually think about it.

Your situation Close now? Why
EAD valid 3+ months past target closing Usually yes Clean file; cap-gap may not even come up
EAD expires before closing, petition pending Possible with the right lender Requires cap-gap I-20 acceptance; fewer lenders
Petition approved, change of status Oct 1 Yes Approval notice is strong evidence
Request for Evidence (RFE) pending Consider waiting Outcome uncertain; harder for underwriting
Premium processing available Consider paying for it A faster decision can unlock more lenders

Whether to use premium processing is your employer's and attorney's call. We only flag that an approval notice in hand widens your lender options.

Illustration: the payment you're committing to

Say Rahul, a hypothetical analyst in Edison, NJ, earns $110,000 and buys a $400,000 condo with 5% down. His loan is $380,000. At 7.40% (Freddie Mac weekly average, Oct 15, 2026 — illustration only, not a quote or offer), principal and interest is about $2,631.04/month, before taxes, insurance, HOA and PMI. He should be confident he can carry that from savings for a few months if his petition hits a snag.

Talk to a loan officer who's seen this before: Cap-gap is the window where lender choice matters most. Send us your I-20, receipt and EAD dates, and we'll tell you which lenders will close on them and which date is safest.

Change of status vs consular processing

Cap-gap applies only when the petition requests a change of status inside the US. If your employer filed for consular processing, cap-gap doesn't extend your status, and your OPT ends on its own date. You'd also need a visa stamp abroad before starting H-1B work.

For a change of status home loan, that difference is huge. Consular processing can mean a trip to India between contract and closing, which is one of the riskiest things you can do with a mortgage in progress. Confirm which route your employer used before signing a purchase contract.

What if the H-1B petition is denied?

This is the scenario to plan for, even if it's unlikely.

If denied before closing: Your cap-gap work authorization ends immediately, and your income can no longer be verified as continuing. Expect the loan to stop. Your earnest money is protected only if your contract has a financing contingency that hasn't expired, so keep that contingency through the decision if you can.

If denied after closing: The mortgage doesn't change. You still owe the payment. DHS gives a 60-day grace period to prepare to depart after a denial. A pending USCIS proposal would end the separate H-1B 60-day grace period; our post on the proposed H-1B grace period rule tracks it. Talk to your immigration attorney about options. On the housing side, our guide on what happens to your mortgage if you leave the US covers renting, selling and managing the loan from abroad.

Cap-gap buyer's checklist

  • Cap-gap I-20 from your DSO

  • I-797C receipt (and I-797A approval once issued)

  • OPT or STEM OPT EAD, even if expired

  • Employer letter confirming continued employment

  • 30 days of paystubs and two years of W-2s

  • Financing contingency that runs past the expected decision

  • Reserves to cover a few months of payments

If you're on STEM OPT rather than initial OPT, your 180-day automatic extension rules differ; see our STEM OPT mortgage guide.

What the rules actually say

  • DHS H-1B modernization final rule (implemented Jan 17, 2025): Cap-gap extension now runs to April 1 of the relevant fiscal year for timely filed cap-subject change-of-status petitions; ends immediately on denial, withdrawal, rejection or revocation.

  • Fannie Mae Selling Guide B2-2-02 (07/28/2015): Non-permanent residents are eligible on the same terms as citizens; the lender determines documentation of legal presence.

  • HUD Mortgagee Letter 2025-09: F-1 and H-1B holders are not eligible for FHA for case numbers on or after May 25, 2025.

  • 8 CFR 214.1(l)(2): H-1B grace period of up to 60 days; a USCIS proposal (Sept 11, 2026) would eliminate it, not final as of October 2026.

Frequently Asked Questions

Q: Can I close on a house during the cap-gap period?
A: Yes, with the right lender. Fannie Mae lets lenders decide how to document legal presence, and an expired OPT EAD plus a cap-gap I-20 and H-1B receipt is a valid package. Some lenders won't accept it and require the approval notice. Ask about this overlay before you schedule the appraisal.

Q: Is it better to wait for my H-1B approval before closing?
A: It usually makes the loan easier. An I-797A approval notice opens up more lenders and removes the denial risk from your contract. If waiting would cost you the house, a lender that accepts cap-gap documents can still close. Match your closing date to your financing contingency and the expected decision.

Q: Does cap-gap apply if my employer chose consular processing?
A: No. Cap-gap only covers timely filed petitions requesting a change of status inside the US. With consular processing, your OPT ends on its scheduled date and you'd need a visa stamp abroad. That can put your income verification and closing at risk, so confirm the filing type with your employer first.

Q: What documents prove my work authorization during cap-gap?
A: Typically your cap-gap I-20 from your DSO, your OPT EAD (even if expired), the I-797C receipt for the H-1B petition, and recent paystubs. An HR letter confirming continued employment helps. Once approved, add the I-797A with its I-94. Lenders vary on exactly which combination they accept.

Q: What happens to my mortgage if my H-1B is denied after closing?
A: The loan terms don't change and you still owe the payment. Your work authorization under cap-gap ends immediately, so talk to your immigration attorney right away. Homeowners in that position typically keep paying from savings, rent the property or sell. Having several months of reserves before closing gives you room to decide calmly.
